  • 2. Plan the payment method: A Spanish bank account can be practical for completion funds, taxes, utilities and ongoing ownership costs, but do not present it as a universal legal prerequisite. Confirm the notary’s accepted payment evidence and your bank’s transfer or bank-draft process well before completion.
  • 3. Independent Legal Due Diligence: Your independent lawyer must obtain a Land Registry excerpt (Nota Simple) from the Registro de la Propiedad to verify legal ownership, confirm square meterage, ensure the asset is debt-free, and inspect the Certificate of Habitability (Cédula de Habitabilidad / Licencia de Primera Ocupación).
  • 4. Reservation or contrato de arras: Private pre-completion agreements are common, but neither a 10% payment nor the legal effect of the money is automatic. The contract should state whether the amount is a reservation payment, part-payment, or arras penitenciales. The Article 1454 walk-away rule—buyer forfeits the arras or seller returns double—depends on the agreement actually having that penitential character.
  • 5. Public deed and registration: Completion normally involves signing the public deed before a Spanish notary and documenting the agreed payment. The deed is then presented for tax formalities and registration with the Property Registry. Do not describe registry completion as instantaneous; processing continues after the notarial signing.
