Buying Property in Spain as a Foreigner 2026: Taxes, NIE, Due Diligence & Residency

Buying a home in Spain? Compare resale transfer tax with new-build VAT, check ownership and charges before signing arras, and plan residency separately.

Non-residents can generally buy property in Spain, but the purchase rules and taxes depend on the buyer, the location and the type of property. Some purchases by non-EU nationals in defence-related restricted zones may require military authorization, while EU nationals are generally exempt from those restrictions. Buying a home doesn’t, by itself, grant Spanish residence rights. Also, the investor-residence provisions once linked to the Golden Visa stopped applying to new cases on April 3, 2025.

Legal Process for Purchasing Real Estate in Spain

Spain generally doesn’t require buyers to become residents before purchasing property. However, the rules for foreign buyers can vary by location. Before signing anything or paying a deposit, check the buyer’s identification requirements, Land Registry status, planning legality, tax treatment and any local authorisation rules. Independent legal advice matters even more when you’re buying remotely, purchasing rural or coastal land, or looking in an area with special restrictions.

Status of the Real Estate Golden Visa Program

Spain’s investor-residence provisions in Articles 63 through 67 of Law 14/2013 lost their effect on April 3, 2025. As a result, buying a new property no longer provides a route to a Golden Visa application. Existing or transitional cases need to be checked against the legislation and the holder’s individual authorization. It’s safest not to assume that every former investor permit will have the same renewal outcome.

New buyers who want to live in Spain need a separate immigration basis, such as a qualifying Non-Lucrative Visa or an international telework authorization.

Step-by-Step Purchase Sequence in Spain

  • 1. Obtain an NIE (Número de Identificación de Extranjero): You’ll need this tax identification number for all financial and property transactions in Spain.
  • 2. Plan the payment method: A Spanish bank account can make it easier to pay completion funds, taxes, utilities and ongoing ownership costs. However, don’t treat one as a universal legal requirement. Confirm which payment evidence the notary accepts, along with your bank’s transfer or bank-draft process, well before completion.
  • 3. Independent Legal Due Diligence: Your independent lawyer should obtain a Land Registry excerpt (Nota Simple) from the Registro de la Propiedad. This verifies legal ownership and the property’s square meterage, checks that the asset is debt-free, and allows your lawyer to inspect the Certificate of Habitability (Cédula de Habitabilidad / Licencia de Primera Ocupación).
  • 4. Reservation or contrato de arras: Private pre-completion agreements are common, but neither a 10% payment nor the legal effect of that money is automatic. The contract should explain whether the amount is a reservation payment, part-payment, or arras penitenciales. The Article 1454 walk-away rule, where the buyer forfeits the arras or the seller returns double, applies only when the agreement gives the payment that penitential character.
  • 5. Public deed and registration: Completion normally involves signing the public deed before a Spanish notary and documenting the agreed payment. The deed then goes through the relevant tax formalities before being presented for registration with the Property Registry. Registry completion isn’t instantaneous, so the process continues after the notarial signing.

Purchase Taxes: Resale vs. New-Build Property

The tax treatment depends on what you’re buying. You shouldn’t use one national percentage for every Spanish property transaction.

PurchaseMain purchase taxWhat to verify
Resale homeTransfer Tax (ITP)The autonomous community sets the applicable rates, bands and reliefs. Check the current regional tax authority for the property’s location.
New home from developerVAT (IVA), generally 10% for ordinary housingReduced treatment can apply to certain protected housing. You’ll also need to check Stamp Duty (AJD) and regional rules.
Canary Islands transactionCanary indirect-tax system rather than mainland IVA in relevant transactionsUse the current Canary tax authority guidance for the exact property and transaction.

Notary, Land Registry, legal, valuation, mortgage and banking costs are separate from the purchase tax. They shouldn’t be presented as fixed percentages for every deal.

Before paying a reservation or arras amount, ask your adviser for a transaction-specific completion budget based on the current tax rules in that autonomous community.

Ongoing Costs After You Buy

  • IBI municipal property tax: You pay this tax to the municipality. It’s calculated using the property’s cadastral value and the local tax rate, so the amount varies between properties and municipalities.
  • Non-resident tax filings: Non-resident owners may have Spanish tax obligations through Modelo 210. These depend on whether you rent out the property, keep it for personal use, where you’re tax resident and other circumstances. Check the current Agencia Tributaria guidance for the relevant tax year.
  • Community fees: Apartments and homes within a community of owners usually carry regular charges for shared buildings or urbanizations. The community may also approve extraordinary assessments.
  • Insurance, utilities and maintenance: These costs depend on the property and can make a noticeable difference to your actual annual carrying costs.

Owners of higher-value properties may also face additional Spanish wealth-related reporting or tax considerations. These depend on residence status, assets and region, so treat them as an individual tax question rather than a standard cost for every property.

Frequently Asked Questions

Can foreigners buy property in Spain without residency?

In general, foreign nationals can buy property in Spain without becoming residents first. The purchase still requires the right tax identification and proper due diligence, though. Some non-EU buyers may also need extra authorization in designated strategic or restricted areas. Check both the location and your nationality before assuming there are no restrictions.

Does buying a property in Spain give you the right to live there?

No. Buying property doesn’t automatically give you Spanish residence rights. The real-estate investment route under the former Golden Visa regime has ended for new applicants, so non-EU buyers who want to live in Spain need to qualify through a separate residence route.

How much should you budget for taxes and fees when buying a home in Spain?

There’s no single national percentage that applies to every purchase. Taxes vary by autonomous community and depend on whether the property is a resale or a new build. Legal, notary, registry, mortgage and other transaction costs also depend on the deal. Calculate the current regional taxes for the specific property instead of relying on a fixed 10%–15% rule.
